This Disclaimer applies to My Experience Africa (“we”, “us”, “our”), our website, communications, and all volunteering, internship, cultural, adventure, sports, childcare, community, and healthcare programmes we arrange in Kenya. It is intended to close gaps around risk, liability, third parties, and information accuracy. If any part of this Disclaimer conflicts with mandatory consumer protections that apply to you by law, those protections prevail to the extent required.
1. Acceptance of this Disclaimer
Your continued use of our website or services constitutes acceptance of this Disclaimer. If you do not agree, do not use the website, do not book a programme, and do not travel with us. Parents or legal guardians who book or consent on behalf of a participant accept this Disclaimer for themselves and on behalf of that participant.
2. Nature of our services
My Experience Africa coordinates volunteer and internship-style placements and related support services in Kenya. We are not:
- An airline, travel insurer, visa agency, medical provider, hospital, school, community organisation, or government authority
- An employer of volunteers or interns (unless separately agreed in writing for a specific role)
- A licensed medical, legal, immigration, or financial adviser
- A guarantor of employment, residency, visas, academic credit, professional licensure, or specific career outcomes
Where we introduce you to host projects, clinics, schools, communities, accommodation, or transport partners, those parties remain independent. Their acts, omissions, standards, and policies are their own, except where liability cannot be excluded by applicable law.
3. Website information & accuracy
Content on this website — including programme descriptions, durations, prices, inclusions, photos, maps, schedules, partner names, and testimonials — is provided for general information and marketing purposes.
- We aim for accuracy but do not warrant that all content is complete, current, or error-free.
- Prices, availability, itineraries, and inclusions may change without prior notice until confirmed in a written booking confirmation.
- Photos and videos may be illustrative, staged, or taken on previous programmes and may not depict your exact placement, accommodation, or group.
- Any typographical, pricing, or listing error may be corrected; we may cancel or amend a booking made in reliance on an obvious error and will notify you promptly.
Only your written booking confirmation (and any documents we expressly incorporate) define the services we commit to provide for your placement.
4. No professional advice
Nothing on this website or in our communications constitutes medical, clinical, legal, immigration, tax, accounting, or professional advice. You must obtain independent advice appropriate to your circumstances before travelling, volunteering, or making decisions based on information we provide.
5. Assumption of risk
International travel, volunteering, community work, sports coaching, cultural activities, adventure experiences, wildlife encounters, and healthcare observation or placements involve inherent and significant risks, including but not limited to:
- Illness, infection, disease, allergic reaction, injury, disability, or death
- Road traffic accidents, aviation incidents, and public transport risks
- Crime, theft, assault, civil unrest, terrorism, or political instability
- Natural disasters, extreme weather, flooding, heat, altitude, or wildlife
- Inadequate or delayed emergency medical care relative to your home country
- Food- and water-borne illness; differences in hygiene and infrastructure
- Emotional distress arising from challenging community or clinical environments
- Risks associated with sports, physical activity, and outdoor programmes
By participating, you voluntarily assume all such risks to the fullest extent permitted by law, whether arising from your own actions, the actions of others, or conditions beyond anyone’s control.
6. Health, medical & vaccination
- You are solely responsible for assessing your fitness to travel and participate, obtaining medical clearance where appropriate, and disclosing relevant medical conditions, allergies, medications, disabilities, or support needs honestly and in good time.
- You are responsible for recommended and required vaccinations, malaria prophylaxis, medications, and health precautions for Kenya and any transit countries.
- We do not provide medical treatment, diagnosis, or emergency clinical care as part of programme fees (except first-aid or facilitation that staff may reasonably offer).
- Failure to disclose material health information may result in declined participation, removal from programme, or inability to arrange suitable support — without obligation to refund fees beyond what our Terms require.
- Any first aid, hospital referral, or medical facilitation we arrange is without warranty and does not create a duty as a healthcare provider.
7. Insurance requirements
Comprehensive travel, medical, evacuation, and personal liability insurance is mandatory for the full duration of your travel and programme, including transit days. Your policy should cover volunteering/internship activities where required, adventure activities if applicable, cancellation, curtailment, and repatriation.
- We may request proof of insurance before or during your programme.
- We are not responsible for uninsured losses, denied claims, inadequate cover, or gaps in your policy.
- We do not sell insurance and do not guarantee that any particular insurer will cover your activities.
8. Travel, visas & documents
- You are solely responsible for valid passports, visas, entry permits, vaccinations certificates, return tickets, and compliance with Kenyan and transit-country immigration rules.
- Any guidance we provide about visas or entry is general information only and may become outdated. Visa outcomes are decided by authorities; we do not guarantee approval, timelines, or entry.
- You are responsible for booking and paying for international and domestic flights and for sharing accurate arrival details in time for transfers.
- Denied boarding, refused entry, deportation, delays, missed connections, airline changes, and baggage issues are outside our control and at your cost and risk.
9. Third-party partners
Programmes rely on independent third parties, including (without limitation) host organisations, schools, clinics, hospitals, community groups, accommodation providers, drivers, guides, activity operators, and payment processors.
- We select partners with care but do not control their day-to-day operations, staffing, facilities, or medical/clinical standards.
- To the fullest extent permitted by law, we are not liable for loss, injury, negligence, misconduct, or failure by third parties.
- Standards of accommodation, transport, and facilities in Kenya may differ from those in your home country.
10. Placements & programme changes
- Placements are subject to partner capacity, seasonality, community needs, safeguarding requirements, and operational constraints.
- We may change project sites, supervisors, schedules, accommodation, meal arrangements, transfer times, or activities where reasonably necessary for safety, legality, capacity, or programme quality, while aiming to preserve the overall character of your booking.
- We do not guarantee a specific host, mentor, patient case mix, classroom assignment, sports team, or daily schedule.
- Volunteer and internship roles are unpaid contribution and learning experiences, not paid employment, unless expressly stated otherwise in writing.
11. Healthcare & clinical placements
If you join a medicine, nursing, midwifery, public health, or related placement:
- You must act only within the scope authorised by local supervisors and applicable Kenyan law and professional rules.
- Observation, shadowing, and supervised tasks do not confer a licence to practise medicine or any regulated profession in Kenya or elsewhere.
- You must not present yourself as a qualified practitioner unless you lawfully hold and are permitted to use such status locally.
- Clinical environments involve biohazard, infection, emotional, and ethical risks. You participate voluntarily and under local supervision.
- We and host facilities may restrict or end your clinical access for patient safety, ethics, competence, or policy reasons.
12. Children & safeguarding
Childcare, education, and community programmes may involve contact with children and vulnerable people. You agree to follow all safeguarding rules we or partners set, including background checks where required, photography restrictions, appropriate behaviour, and reporting duties. Breach may result in immediate removal without refund. We prioritise the welfare of children and communities over any participant preference.
13. Conduct, laws & removal
You must obey Kenyan law, respect local customs, and follow staff and partner instructions. Alcohol or drug misuse, sexual misconduct, harassment, discrimination, violence, illegal activity, or behaviour that endangers others may result in removal from the programme, accommodation, or activities without refund, and referral to authorities where appropriate. You remain responsible for all costs of early departure.
14. Personal property & belongings
You are responsible for your money, documents, electronics, valuables, and personal belongings at all times. We are not liable for loss, theft, damage, or delay of personal property, including in accommodation, transport, or project sites, except where liability cannot be excluded by law.
15. Force majeure & disruptions
We are not liable for failure or delay caused by events beyond our reasonable control, including but not limited to natural disasters, epidemic or pandemic, government action, border closures, strikes, war, terrorism, civil unrest, utility failure, partner withdrawal, extreme weather, or infrastructure breakdown. In such cases we may postpone, modify, suspend, or cancel services and will act reasonably regarding alternatives or remedies as set out in our Terms.
16. Limitation of liability
To the fullest extent permitted by applicable law:
- We exclude all implied warranties regarding programmes, website content, and third-party services, except those that cannot legally be excluded.
- We are not liable for indirect, incidental, special, punitive, or consequential losses, including loss of enjoyment, opportunity, income, data, or anticipated savings.
- Our aggregate liability arising out of or relating to a booking or programme is limited to the total programme fees you actually paid to My Experience Africa for that booking.
- Nothing in this Disclaimer excludes or limits liability for death or personal injury caused by our negligence where such exclusion is prohibited, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded by law.
17. Indemnity
To the fullest extent permitted by law, you agree to indemnify and hold harmless My Experience Africa, our owners, officers, employees, agents, and contractors from and against claims, losses, damages, costs, and expenses (including reasonable legal fees) arising out of: your breach of this Disclaimer or our Terms; your unlawful or negligent acts or omissions; your failure to obtain insurance, visas, or medical clearance; claims by third parties related to your conduct; or your participation in activities outside our organised programme.
18. Photos, media & testimonials
We may photograph or film programme activities for safety, training, or promotional use. By participating, you consent to reasonable use of your image and testimonials in our marketing unless you notify us in writing that you opt out (and subject to safeguarding rules for children). Website testimonials reflect individual experiences and are not guarantees of your results or experience.
19. Payments & third-party processors
Payments may be processed by third parties (for example PayPal). Their terms, fees, currency conversion, chargebacks, and data handling apply in addition to ours. We are not responsible for processor outages, banking delays, or FX differences. Until cleared funds are received as required, your place may not be secured.

Our website may link to third-party sites. We do not control or endorse their content, policies, or practices and are not responsible for any loss arising from your use of them.
21. Minors & guardians
Participants must meet our minimum age requirements. Where a participant is under 18 (or under the age of majority in their home jurisdiction), a parent or legal guardian must provide required consents and remains responsible for the minor’s compliance, supervision arrangements we specify, and all obligations under this Disclaimer and our Terms.
22. No employment or immigration guarantee
Participation does not create an employment, agency, partnership, or joint-venture relationship with us or host partners unless expressly agreed in writing. Programme participation does not guarantee any visa category, work authorisation, residency, university credit, professional registration, or future job placement.
23. Intellectual property
All website content, branding, logos, and materials are owned by My Experience Africa or our licensors. You may not copy, scrape, republish, or commercially exploit them without prior written permission.
24. Privacy
Personal data is handled as described in our Privacy Policy. You are responsible for the accuracy of information you submit and for keeping emergency contact details current.
25. Changes to this Disclaimer
We may update this Disclaimer at any time. The “Last updated” date will change when we do. Continued use of the website or services after updates constitutes acceptance of the revised Disclaimer. For confirmed bookings, material changes will be communicated where reasonably practicable; mandatory legal updates may apply immediately.
26. Severability
If any provision of this Disclaimer is held invalid or unenforceable, the remaining provisions continue in full force and effect. Invalid provisions shall be modified to the minimum extent necessary to make them valid and enforceable while preserving intent.
27. Governing law
This Disclaimer is governed by the laws of Kenya. Disputes should first be raised with us in good faith. Subject to mandatory consumer rights in your country of residence, courts in Kenya shall have jurisdiction.
